EVENT DESCRIPTION
The BIPLA Patent Office Practice Committee invites you to a hybrid Brown Bag Lunch to discuss the USPTO’s Request for Comments on the impact of the proliferation of AI on prior art, the knowledge of a person having ordinary skill in the art (“POSA”), and determinations of patentability. The Request seeks input on 15 questions related to, for example, how AI impacts the assessment of prior art under 35 U.S.C. § 102, whether a POSA must be a human, and how the use of AI as a tool may impact the knowledge of a POSA, the meaning of claim terms, what is analogous art, whether there is a rationale to modify the prior art, enablement, and what guidance the USPTO might consider to assist practitioners in assessing these issues.
