Boston IP lawyer Craig R. Smith says Gorton’s original summary judgment order was “probably correct.”

“The plaintiffs have the burden of putting forth evidence that suggests that the [discovery rule] exception applies,” Smith says. “There didn’t seem to me to be evidence to support the application of the exception.”
