Craig R. Smith, a patent litigator in Boston, said he foresees the possibility that the risks associated with the coronavirus become an area of inquiry in voir dire.

“As a trial lawyer, you’re hoping to pick a jury that is going to be fair, listen to the evidence, and make decisions based on the evidence,” Smith said. “You don’t want jurors thinking about whether they are going to get sick or worried about what would happen if someone starts coughing.”
