L&A Litigation Team Wins Patent Litigation for AllPure Technologies

Craig R. Smith

Cambridge, MA – Lando & Anastasi won a major patent litigation victory on behalf of AllPure Technologies. In a multi-year litigation with industry giant EMD Millipore Corporation, AllPure proved that its TAKEone® aseptic sampling system does not infringe the patent claims asserted by Millipore. First, Lando & Anastasi’s litigation team successfully obtained summary judgment of non-infringement. The district court held that the AllPure “TAKEONE device thus does not literally infringe, nor does it provide an infringing equivalent of the ‘removable, replaceable transfer member’ claimed in the ‘543 patent. For this reason, summary judgment of noninfringement must enter for AllPure.” Then, the Court of Appeals for the Federal Circuit affirmed Lando & Anastasi’s win for AllPure. In a precedential opinion, the Federal Circuit held that AllPure’s TAKEone sampling system did not literally infringe the patent and that Millipore was barred from accusing AllPure of infringement under the doctrine of equivalents.

“We are very pleased with the outcome of this litigation and thrilled with the work that Craig Smith and the attorneys at Lando & Anastasi performed to resolve this case,” said AllPure CEO, Dr. Michael Zumbrum. “Throughout this process, Lando & Anastasi’s litigation team worked aggressively and efficiently to win this case. We are very happy with the strong working relationship we have developed with Lando & Anastasi over the years and are excited about moving forward with our popular TAKEone aseptic sampling system.”

L&A Partner Craig Smith argued the case on behalf of AllPure in both the district court and at the Federal Circuit. The L&A trial team representing AllPure on this matter also included attorney Eric Carnevale. Click here to read the Federal Circuit opinion.
