Angelyn will conduct an extended roundtable discussion on obviousness-type double patenting, a key topic followed closely by many in the life sciences industry and beyond. Attendees will have the opportunity to discuss in small groups the challenges of ensuring that the full statutory and adjusted patent term is protected while incentivizing innovation and collaboration with third parties. She will also discuss tips and tricks for rebutting rejections from the patent office when rendered. The debate surrounding obviousness-type double patenting—also called nonstatutory double patenting—often focuses on finding a balance between many competing interests, and the risks related to these issues are not always readily apparent. Courts and policymakers continue to grapple with how to best address these issues in patent law, as evidenced by recent decisions by the Federal Circuit and lower courts.

While the courts have provided some guidance in recent years, there are still many open questions for patent attorneys to weigh.
