Andrea B. Reed

Overview

Andrea is a seasoned practitioner, with experience representing clients in a variety of industries in patent infringement, trademark infringement, and other complex intellectual property litigation. She counsels technology companies through all stages of litigation, including preliminary injunctions, electronic discovery, claim construction, dispositive motions, settlement, trial, and appeal. She also advises on IP agreement enforceability, breach, termination, risk analysis, and related business considerations.

Andrea has represented clients in federal district courts throughout the country and on appeal to the U.S. Court of Appeals for the Federal Circuit. She also has experience working with mediators and negotiating technology license and settlement agreements.

Andrea has deep technical experience in materials science and manufacturing. She has worked with companies in a wide range of technologies, including petrochemical (polymer manufacturing), biotechnology (microbial inoculants), food technology (modified wheat protein isolates), and medical devices (radiopaque skin markers and blood gas analyzers), as well as consumer products.

Prior to joining L&A, Andrea worked in the Boston office of an international law firm and as in-house counsel for a publicly traded software company. Before starting her legal career, she worked in the medical device manufacturing industry, where she formulated polymer blends for injection molded bioabsorbable orthopedic screws and soft tissue fixation pins. She has on-the-ground experience working in Class 10,000 (ISO 7) clean room manufacturing facilities.

Andrea regularly presents at CLE programs and serves as a moderator for panel discussions on a variety of IP issues, including for the New England Corporate Counsel Association, The Association of Corporate Counsel, and Startup Boston. Additionally, one of Andrea’s many interests, is pro bono representation of disabled children in immigration proceedings, in partnership with the nonprofit organization Kids in Need of Defense (KIND).

Representative Experience

WBIP, LLC v. Kohler Co. – (D. Mass. and Fed. Cir.) Served as trial and appellate counsel for plaintiff Westerbeke in a patent infringement case concerning low carbon monoxide marine generators. Result was a successful jury verdict of patent infringement with $8.3M award of enhanced damages and attorneys’ fees. Affirmed on appeal.
Loken-Flack, LLC v. Novozymes Bioag, Inc. – (D. Colo. and Fed. Cir.) Represented defendant Novozymes in an inventorship dispute concerning agricultural crop treatments. Obtained summary judgment of correct inventorship. Affirmed on appeal.
Source Search Technologies, LLC v. KAYAK Software Corp. – (D.N.J. and Fed. Cir.) Represented defendant KAYAK in a patent infringement case concerning travel services software systems. Obtained partial summary judgment of invalidity and non-infringement, final summary judgment of patent ineligibility and attorneys’ fees. Affirmed on appeal.
